Cyber security expert witnesses provide forensic investigations and opinions on failures to guard against computer crimes that involve the Internet, unauthorized access to computer systems and data connected to the Internet (data breaches), including issues of data privacy, cyber security standards, reasonable standards of care, theft of customer records and failure to notify affected customers, and cyberlaw. These internet security experts may provide forensic services related to “computer hacking”, including phishing, viruses/trojens and other malicious software programs, keyloggers, Denial of Service (DoSDDoS) attacks, waterhole attacks, fake WAP, eavesdropping (Passive Attacks), ClickJacking attacks, cookie theft, bait and switch hacks, and other techniques for attacking computers, Internet of Things (IoT devices and digital networks. These cyber security professionals may consult on data kidnapping and ransom attacks (eg: ransomware), and other forms of damage to data and systems from criminals working outside or inside computer networks, or any issues involving the protection of information from all (non-physical) threats to the integrity and availability of data and data systems. These cybersecurity experts may opine as well on issues of data privacy and compliance with privacy standards, including the intentional transmission of private information to third parties as well as failures to adequately protect private data from theft, and data breach policies and obligations to report breaches. These cyber professionals may provide forensic consulting on issues involving data security flaws, software and network process violations of data protection laws and industry standards, including the European General Data Protection Regulation (GDPR), the Health Insurance Portability and Accountability Act (HIPAA), Health Information Technology for Economic and Clinical Health (HITECH) Act, Payment Card Industry Data Security Standard (PCI DSS), Fair Credit Reporting Act, Employee Retirement and Income Security Act (ERISA, disciplinary rules of professional conduct, US-EU Safe Harbor and the protection of personal data, data breach disclosure laws, individual state data protection requirements (eg: Massachusetts Data Protection Act) and related laws and regulations.
