Rules of Evidence, commonly referred to as the law of evidence, govern the proof of facts in a legal proceeding, determining what evidence is to be considered by the trier of fact in reaching its decision. These Rules also govern the type of proof, amount and quality of evidence needed to prevail in litigation. Oct 25 ’11 — The Supreme Court of Virginia approved the “Virginia Rules of Evidence” (in PDF link) Sept. 12, 2011, but the Rules have not yet been enacted by the legislature. The enactment of a state code of evidence is expected during the 2012 legislative session.
